Welcome to Better Keep Notes. These Terms of Service ("Terms") govern your access to and use of the Better Keep Notes application and services ("Service") operated by Foxbiz Software Pvt. Ltd. ("Company", "we", "us", or "our").

3. User Accounts

3.1 Account Creation

3.2 Account Requirements

5.3 Content Responsibility

You are solely responsible for the content you create and store. We do not monitor or review user content unless required by law.

6. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Foxbiz Software Pvt. Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Better Keep Notes name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.

8. End-to-End Encryption and Data Recovery

8.1 Encryption Overview

Better Keep Notes uses end-to-end encryption (E2EE) by default to protect your notes when syncing to the cloud. This encryption is mandatory and cannot be disabled. Your notes are encrypted on your device before being transmitted to our servers. We do not have access to your encryption keys, PIN, or recovery key.

8.2 Your Responsibility for Encryption Credentials

When using cloud sync, you are solely responsible for:

Remembering your encryption PIN or password
Safely storing your recovery key in a secure location
Understanding that these credentials cannot be reset or recovered by us

Critical Warning: If you forget your encryption PIN and lose your recovery key, your encrypted notes will be permanently inaccessible and unrecoverable. Foxbiz Software Pvt. Ltd. cannot decrypt, recover, or reset your encryption credentials under any circumstances. This is by design to ensure only you can access your encrypted data.

8.3 No Liability for Encryption-Related Data Loss

You expressly acknowledge and agree that Foxbiz Software Pvt. Ltd., its officers, directors, employees, and agents shall not be held liable for any loss of data, notes, or content resulting from:

Forgotten encryption PIN or password
Lost, misplaced, or inaccessible recovery key
Failure to properly back up your recovery key
Inability to decrypt your notes for any reason related to lost credentials
Device loss or damage where encryption keys were stored

By using cloud sync, you accept full responsibility for maintaining access to your encryption credentials and understand the irreversible consequences of losing them.

9. Service Availability

We strive to provide reliable service but cannot guarantee:

Uninterrupted or error-free service
Compatibility with all devices or browsers
That defects will be corrected immediately
That the Service will meet all your requirements

We may modify, suspend, or discontinue the Service at any time with reasonable notice when possible.

10. Subscription and Payments

Some features of the Service may require a paid subscription. If you choose to subscribe:

Payments are processed through third-party payment providers
Subscriptions automatically renew unless cancelled
Refunds are subject to our refund policy and applicable laws
Prices may change with advance notice

11. Limitation of Liability

To the maximum extent permitted by law, Foxbiz Software Pvt. Ltd. shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, goodwill, or other intangible losses
Any damages resulting from unauthorized access to or use of our servers
Any interruption or cessation of transmission to or from the Service
Any loss of encrypted data due to forgotten PIN, password, or lost recovery key
Any inability to access or decrypt notes when encryption credentials are unavailable

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to indemnify and hold harmless Foxbiz Software Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use the Service will immediately cease
You may export your data before account deletion (where technically feasible)
We may delete your account data after a reasonable period

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:
